Open Question: how is to blame when I hit a car on its left rear side and cops gave me an unsafe lane change?

I was driving on the highway about to turn right for the exit ramp. I see a car behind me but no one on the exit ramp lane so I turn on my signal and start turning right and when I am about half the lane in my mother yells watch out and out of the corner of my eye i see the car that was behind me speeding pass me and I manage to clip him on the rear left side he spins out of control. the messed up thing is that before the cops came he had confessed that he had seen me signal but thought he could "make it" yet later changes his story to the cops saying that he had passed me and then I hit him. Think about this... if he is in back of me and turns right for the exit ramp how in the world does was he able to pass me when while in the exit ramp the speed limit is 50 and the main line is 60 he had to have been speeding right please give me your thoughts..... the other driver did not have a license and his car was fixed to race sort of like fast and the furious style... and since with out a license he could not have had insurance also the fact that the car was fixed up to run at a high speed in any way does it give me any advantage in the eyes of the judge. meaning that his car could discribe his driving "personality" as unsafe or hazardous..... the other driver did not have a license and his car was fixed to race sort of like fast and the furious style... and since with out a license he could not have had insurance also the fact that the car was fixed up to run at a high speed in any way does it give me any advantage in the eyes of the judge. meaning that his car could discribe his driving "personality" as unsafe or hazardous..... do you guys think I have a fighting chance???
